Michigan No-Fault Work Loss Benefit Maximum
The Michigan No-Fault Act allows qualified individuals to receive several benefits from no-fault insurance providers. One of the benefits is the “work loss benefit.” The work loss benefit will be granted in two instances: (1) a qualified individual who is employed suffers an injury that limits the individual’s ability to work or (2) a qualified individual is temporarily unemployed. Eligible individuals for wage loss will receive 85% of the gross pay the individual would have earned from work he or she would have performed had the accident not occurred. The eligible individual will receive the benefit for no more than 3 years and may lose the benefit if he or she returns to work. Moreover, the work loss benefit is subject to a monthly maximum, which is adjusted each October to keep pace with living costs. The Director of the Department of Insurance and Financial Services sets the monthly maximum each October.
