In an unwritten Opinion, Judge Stone held that it was proper to separate and sever the plaintiff’s third party tort claim for serious impairment of body function from plaintiff’s claim for first party no-fault benefits. The motion to sever was brought by the third party tort defendant arguing that joining him with the PIP insurance company defendant would be prejudicial.
