CASE SUMMARY:  
In a rehearing on item number 275, District Court Judge Miles, relying on Brunec v DAIIE (item number 307), increased plaintiff’s attorney fee under §3148 to a total of $5,367. This award was based on an hourly rate of $60 per hour. In addition, it was awarded in spite of the fact that the attorney fee exceeded the principal recovery and notwithstanding the fact that the retainer agreement between plaintiff and his attorney provided a one third contingency fee.
