CASE SUMMARY:
In a written Opinion, Eaton County Circuit Court Judge Richard Robinson ruled as follows:

1.    A plaintiff who was injured riding a motorcycle which was struck by an insured automobile was not entitled to recover for damages to his motorcycle nor for medical expenses from the negligent driver.

2.    Plaintiff husband's claim for loss of consortium is not proper under the no-fault statute inasmuch as it is a noneconomic loss which is not specifically preserved or recognized in the language of §3135(1) of the act. Accordingly, motion for summary judgment in favor of defendant on the issue of loss of consortium was proper.
