Uninsured Motorist Benefits: Setoffs Applicable to Uninsured Motorist Case

CASE SUMMARY:
This decision primarily dealt with issues involving uninsured motorist arbitration and not pure no-fault issues. However, the Court of Appeals did hold, consistent with the decisions in Schigur (item number 58) and American Fidelity (item number 54), that the insurance company could offset, against its liability under the uninsured motorist coverage, any no-fault personal protection insurance benefits that the carrier paid under no-fault first party coverage. Judge D. E. Holbrook dissented on the setoff issue.
