CASE SUMMARY:  
District Judge Karl J. Erickson ruled that under the "mini-tort" provisions of §3135(2)(d), the legislature had abolished tort liability for property damage to moving motorcycles caused by motor vehicles and that the abolition of tort liability was not modified by the passage of the mini-tort provision of the Act.

[Author's Comment: The Miller and Weaver cases summarized above are consistent with the holding in Melton v Matice, item number 386, and contrary to the holding in Perez v Landis, item number 479, above.]
