CASE SUMMARY:  
In another Opinion regarding the case summarized in item number 422, Judge Charles Farmer held that exemplary damages could properly be recoverable to compensate plaintiff for "humiliation, sense of outrage and indignity resulting from injuries maliciously, willfully and wantonly inflicted by the defendant." However, the defendant's conduct must be something more than negligence or gross negligence in order to entitle a plaintiff to recover exemplary damages.
