CASE SUMMARY:  
In a written Opinion, Judge Bosman awarded no-fault benefits to a Michigan resident who was injured while operating his employer's Indiana registered truck in Indiana. The plaintiff was a Michigan resident. The truck was registered in Indiana, owned by an Indiana corporation and insured by a policy issued in Indiana. However, the Indiana insurer had filed a certificate under §3163. The truck was driven in the state of Michigan in excess of 30 days per calendar year. The Court stated that the plaintiff was entitled to benefits pursuant to §3111 of the Act in that the accident occurred within the United States, the injured person was insured under a no-fault policy or was an occupant of a vehicle involved in the accident whose owner was insured under a policy which complied with the No-Fault Act. Furthermore, plaintiff was not disqualified from recovering benefits under §3112 because he was not a nonresident.
