CASE SUMMARY:
In this short written decision, Judge Mustonen held that motorcyclists who sustain property damage cannot utilize the new "mini tort" provisions of §3135(2) to recover for damages to the motorcycle caused by motor vehicle accidents. Judge Mustonen reasoned that the legislature had specifically exempted motorcycles from the definition of vehicles in the Act and the mini tort permits recovery only for damages to motor vehicles.
