CASE SUMMARY:  
In this written Opinion, Judge Brown rejected plaintiff’s contention that an allegation of an insurer's breach of a fiduciary duty or statutory obligation did not allege any tortious conduct independent of the no-fault insurance contract, and, therefore, defendant was entitled to summary judgment on the plaintiff’s claim for mental anguish and exemplary damages.
