CASE SUMMARY:  
Judge Marietti ruled that when a no-fault recipient wins a social security disability award with the assistance of attorney, the no-fault carrier may not offset from no-fault benefits pursuant to §3109(1) the amount of the social security award which is allocated toward attorney fees.
