In this written Opinion, District Judge Dunbar Davis declined to rule that a broken ankle was a serious impairment of body function as a matter of law. The judge cited Cassidy v McGovern and concluded that reasonable men might reach different conclusions with the facts in this case. Therefore, the motion was denied.
