CASE SUMMARY:
In this unpublished per curiam Opinion, the Court of Appeals affirmed the decision of the trial court in favor of defendants on the issue of serious impairment of body function. In this pre-DiFranco decision, the Court found that, although plaintiff’s back pain was unfortunate, her injury had not affected her mode of living in any significant way. Plaintiff was never hospitalized for her injuries, continued to work 40 hours per week, and continued to perform her household chores. Citing Cassidy, the Court found that entry of summary disposition was proper.
