CASE SUMMARY:
In a written Opinion, Judge Freeman held that due to the fact that motorcycles were "excluded from the no-fault statute" and that the Supreme Court in Shavers had sustained this exclusion, a motorcyclist who was injured in an automobile accident could recover in tort against the insured automobile tortfeasor all economic losses (wage losses and medical expenses). The Opinion did not deal with the motorcyclist's right to claim noneconomic losses (pain and suffering) inasmuch as those claims had been settled prior to trial.
