CASE SUMMARY:   
Circuit Judge Swallow ruled that the Court of Appeals decision in Shavers v Attorney General, 65 Mich App 355, which held that the abolition of tort remedies for property damage was unconstitutional, does not bind his Court as the decision emanated from the first Circuit Court of Wayne County. Accordingly, Judge Swallow upheld the no-fault statute's abolition of tort claims for property damage.
