CASE SUMMARY:
In a decision by Judge Bashara dealing with an issue of first impression, the Court of Appeals held that a motorcycle is excluded from receiving property protection insurance benefits under §3123 in that a motorcycle is a "vehicle" for purposes of the property protection exclusion set forth in that section. Therefore, property protection benefits are not payable for physical damage to motorcycles.
