CASE SUMMARY:
In this written Opinion, Judge Neitzel held that a person injured in an automobile accident during the course of his employment need not await the determination of a workers' compensation claim before he can proceed in a civil action for no-fault benefits arising out of the same injury. In so holding, the court denied the defendant insurer's motion to hold in abeyance pending decision of the workers' compensation tribunal.
