CASE SUMMARY:
This written Opinion and order deals with the subject of post-judgment discovery of an insurance company's claim personnel to determine their reason for denying plaintiff’s wage loss claim. At the deposition of the claims manager, defense counsel objected to communications between himself and the company on the grounds of the attorney-client privilege and work product. In his opinion, Judge Sanborn ruled that the privilege does not apply when the reasonableness of the insurance company or its attorney is at issue.
