CASE SUMMARY:
In this short written Opinion by Judge Graves denying defendant's motion for summary disposition on the threshold issue, Judge Graves held that an injury which interferes with a person's normal sexual relations is one which adversely affects the ability to live a normal life. In addition, pursuant to the Court of Appeals' earlier opinion in Franz v Woods (Item No. 862) acute muscle spasms constitutes objectively manifested injury, as does degenerative changes demonstrable by CAT scan and myelograms.
