Uninsured Motorist Benefits: Uninsured Motorist Benefits in Motorcycle Accidents


CASE SUMMARY:
In this unanimous unpublished per curiam opinion, the Court of Appeals affirmed denial of uninsured motorist benefits to the estates of two decedents who were killed while riding a motorcycle. The decedents had an uninsured motorist policy with Progressive which excluded coverage while occupying any “vehicle” owned by the policyholder. The term “vehicle” as used in the exclusion was not in bold face and thus, was not subject to the general policy definitions. Accordingly, the word was to be given its ordinary common sense definition. In that regard, it is common sense that a motorcycle is considered a motor vehicle. Therefore, the exclusion applied and no coverage for uninsured motorist benefits was available.
