CASE SUMMARY:
In an unpublished decision, the Court of Appeals held that where a motorcyclist is involved in an automobile accident with an automobile and there is no no-fault policy extending no-fault benefits to the motorcyclist, the motorcyclist is entitled to recover personal insurance protection benefits from the insurer of the automobile involved in the accident The Court reasoned that the motorcyclist is considered a "non-occupant" pursuant to §3115 of the no-fault statute.
