CASE SUMMARY:   
The court confronted the same issue decided in the Gaines case by Judge Kaufman, of the Wayne County Circuit Court However here, the Ingham County Bench ruled that §3135 did not violate equal protection by arbitrarily establishing two classes of tort victims; those injured by insured tortfeasors and those injured by uninsured tortfeasors. Even though the victims have different remedies available to them, the court felt it was the legislature's intent to provide additional incentive to the registrant of a motor vehicle to obtain the required insurance.
