CASE SUMMARY:
In a letter to the author from counsel in this case, it was stated that the summary for item number 192 was incomplete in that it did not mention Judge Miles' Opinion regarding the wage loss issue. Using the analogy to workers' compensation, Judge Miles awarded "differential" wage loss benefits to the plaintiff who had returned to work after an accident but was earning less money than before. The judge held that inasmuch as the plaintiff was making less money than he would have made prior to the accident, the no-fault insurance company was liable to pay 85 percent of the difference.
