CASE SUMMARY:  
In a decision explained in a letter to the author, District Judge Lozo, sitting as a Circuit Judge, issued an oral opinion from the bench during a jury trial in a third party tort claim, ruling that evidence of a fracture and/or scarring in and of itself, was not sufficient to establish a prima facie case of serious impairment of body function and/or serious, permanent disfigurement The plaintiff had suffered a fracture of her left arm and some scarring on the right arm. The second plaintiff had suffered minor scarring slightly above and next to his right eye.
